Terms and Conditions for VHS to DVD Transfer

Payment is due in full when placing an order unless otherwise agreed upon by both parties.  A 3% transaction fee applies to all credit card payments.

The customer agrees that they alone are responsible for monitoring and creating back-ups of their original videotapes.  The service provider is not responsible for damaged or broken tapes submitted by the customer.

Please DO NOT send copyrighted material.  We cannot legally reproduce it.

When ordering, the customer acknowledges that they have read and accepted the terms and conditions of the contract.  The customer ensures that they are the owner or are authorized by the copyright owner to use any content they submit.  The customer is solely responsible for and assumes all copyright liability for all content they submit.

The customer agrees to indemnify the service provider and any third-party provider against any and all claims and expenses, including attorneys' fees, arising from the customer's use of the service. This expressly includes claims or any and all liability arising from the violation or infringement of proprietary rights or copyrights.

The customer specifically agrees that the service provider or third-party content or service providers are not liable for any conduct by the customer associated with the service, including, but not limited to, videotape content.

All material provided by the service provider including, without limitation, text, software, photos, video, graphics, music and sound, are protected by U.S. and international copyright laws, both as individual works and as a collection. Copyrighted material provided by the service provider or a third-party content provider may only be used for personal use by the customer. The customer may not copy, reproduce, retransmit, distribute, publish, commercially exploit, or otherwise transfer any such copyrighted material in any format, electronic or otherwise.

The customer agrees that they have read their DVD owner's manual to ensure their machine will play the DVD-R, VCD, or SVCD media format they are ordering.  The customer agrees the service provider is not responsible for customers' DVD players that do not accept these formats.

The DVD-R, VCD, or SVCD media the service provider supplies is warranted 30-days from shipment  to the customer for physical defects.  Use of the service is entirely at the customer's own risk. The service is provided on an "as is" basis without warranties of any kind, either expressed or implied. Neither the service provider nor any third-party content or service provider makes any warranty with respect to any content, information, services, or products provided through or in conjunction with the service.

Rush Order option may not always be available.  Subject to current order volume.

Orders are filled on a first come first serve basis.  In general expect a turn-around time of 5 days plus one additional day for each disk ordered.  The customers will be given an estimated delivery date with their order confirmation.
